Adoption of a law banning same-sex marriages: What balance between tradition and individual rights?

In Namibia, a law recently passed by the upper house of parliament is provoking strong reactions. This new legislation aims to prohibit the recognition of marriages contracted abroad between two people of the same sex. In response to a previous Court of Appeal ruling allowing such unions, legislators decided to abolish this measure.

In addition, the new law makes it a criminal offence to celebrate, participate in, promote or advertise such a marriage, exposing offenders to a prison sentence of up to six years, or a fine of up to the considerable sum of 100,000 US dollars, the equivalent of 5,000 US dollars.

The debate on same-sex marriage has long been at the heart of discussions in Africa and in many countries around the world. Some arguments focus on respect for traditions and cultural values, while others emphasize individual rights and the fight against discrimination.

Namibia, like other African nations, faces complex challenges when it comes to reconciling these different perspectives. On the one hand, some defenders of the law argue that marriage should be exclusively between a man and a woman, in line with the country’s traditional values. In their view, the new law is designed to preserve the integrity of society and respect deeply-rooted beliefs. Same-sex marriages have been banned in Namibia since 1927.

On the other hand, opponents of the law point out that this measure runs counter to individual rights and equality before the law. The adoption of this law also raises questions about international pressure, sanctions and interference in the internal affairs of African countries. Some Western countries have taken punitive measures against nations with laws considered discriminatory against LGBTQ+ people. This raises questions about national sovereignty and diplomatic relations between these countries.

On the other hand, some critics of the new law claim that it could have negative economic consequences for Namibia. Indeed, several Western countries have already announced financial sanctions and cut foreign aid in response. These actions could affect the country’s social programs and economic development.

The need to respect the culture, individual rights, priorities and sovereignty of African countries

In this context, it is essential to advocate a more pragmatic and progressive approach. We need to strike a balance between respect for cultural traditions and respect for individual rights. Some suggest opening a dialogue between the various stakeholders to find a consensus that reflects the evolution of societal values and respect for human rights. Beyond the issue of same-sex marriage, this debate also raises broader questions about Africa’s development priorities. Some believe that African countries need to focus on issues such as education, health, infrastructure and economic development, rather than being distracted by social and cultural debates.
